Реферат

В статье раскрываются особенности правоприменительной деятельности следователя и дознавателя при выезде на место происшествия в лесной массив для обнаружения, фиксации и изъятия следов преступления по факту незаконной рубки лесных насаждений. Автором выявлены типичные ошибки, допускаемые субъектом расследования при проведении осмотра места происшествия, который имеет свою специфику по уголовным делам указанной категории. С учетом особенностей места происшествия сформулированы рекомендации по производству его осмотра. В частности, обосновано обязательное участие в осмотре места происшествия представителя лесничества, которого предлагается наделить процессуальным статусом
специалиста (лесовода), с целью измерения диаметра незаконно срубленных деревьев, необходимого для вычисления их общей кубатуры. Данная процедура имеет большое значение для
правильного определения суммы материального ущерба и квалификации преступления. Крометого, диаметр спиленных деревьев и их порода позволяют определить места сбыта незаконно
полученной древесины, а также предположительный круг лиц, причастных к совершению преступления. Аргументируется авторская позиция об определяющем значении осмотра места происшествия для последующего этапа расследования уголовных дел данной категории.

Abstract

The article is devoted to the analysis of the peculiarities of law enforcement activities of the investigator and inquirer during the crime scene search in the forest area with the
purpose to detect, record and seizure the traces of crime connected with the illegal logging of forest plantations. The author reveals typical mistakes made by the subject of investigation during the crime
scene inspection, which has its own specifics in criminal cases of this category. Taking into consideration the peculiarities of the crime scene, the recommendations for conducting its search are formulated.
In particular, the participation of the representative of the forestry in the crime scene investigation is substantiated. It is proposed to give him (or her) the procedural status of a specialist (forester),
in order to measure the diameter of illegally felled trees necessary to calculate their cubature. This procedure is of great importance for the correct determination of the amount of material damage
and the qualification of crime. Besides, the diameter of the logged trees and their species allow tolocate the places of sale of illegally obtained wood, as well as to determine the persons involved in
crime commission. The author’s opinion concerning the significance of the crime scene search for the subsequent stage of the investigation of criminal cases of this category is argued.
