Роль и место подразделений охранно-конвойной службы в правоохранительных системах России и зарубежных стран: научный обзор

Реферат

В статье на основе использования сравнительно-правового метода исследуются модели организации охранно-конвойных подразделений органов внутренних дел в России и зарубежных странах. Рассматривается опыт Франции, Испании, США, Казахстана, Украины. В качестве ключевых объектов сравнения выбраны ведомственная принадлежность, структура и функции подразделений, осуществляющих охрану и конвоирование лиц, подозреваемых и обвиняемых в совершении преступлений, а также осужденных. Выявлены общие и особенные черты в моделях организации охранно-конвойных подразделений, их роль и место в правоохранительных системах рассмотренных стран. Определено, что в Российской Федерации охранно-конвойные подразделения имеются в составе нескольких федеральных органов исполнительной власти и выполняют задачи по охране и конвоированию различных категорий лиц. Правоохранительные системы стран ближнего зарубежья (Украины и Казахстана) обладают некоторым сходством с российской системой, однако функции по охране и конвоированию в них возложены на специальные подразделения национальных гвардий. В странах Западной Европы схожие функции в области охраны правопорядка выполняют полиция и жандармерия (гвардия). Наибольшей спецификой организации охранно-конвойной службы характеризуются США.

Abstract

By using comparative legal analysis, the author of the article studies the models of organizing the security and convoy service units of law enforcement agencies in Russia and foreign countries. The experience of France, Spain, USA, Kazakhstan, Ukraine is considered. Departmental affiliation, structure and functions of the units that carry out the protection and escort of persons suspected and accused of committing crimes, as well as convicts, are chosen as the key objects of comparison. Common and special features of the models of organizing the security and convoy service units, as well as their role and place in the law enforcement systems of the countries under consideration, are revealed. It is determined that in the Russian Federation security and convoy units are the part of several federal executive bodies and they carry out the tasks of protecting and escorting various categories of persons. The law enforcement systems of the neighboring countries (Ukraine and Kazakhstan) have some similarities with the Russian system, but the functions that concern protecting and escorting in these countries are assigned to special units of the National Guard. In Western Europe, the police and the gendarmerie (guard) perform similar law enforcement functions. The security and convoy service of the United States is characterized by the greatest specifics of its organization.
