Аннотация

В статье раскрываются понятия «лицензионно-разрешительная система» и «лицензионно-разрешительная работа войск национальной гвардии Российской Федерации». Проанализированы задачи войск национальной гвардии по осуществлению контрольно-надзорных полномочий и предоставлению государственных услуг в сфере оборота оружия, а также частной охранной и частной детективной деятельности. Рассмотрены особенности механизма
правоприменительной деятельности войск национальной гвардии в сфере лицензионно-разрешительной работы и процедура исполнения принятых решений как одна из правоприменительных стадий, методы и меры государственного принуждения, которые применяются в рамках осуществления лицензионно-разрешительной деятельности. Обращено внимание на имеющиеся проблемы организационного характера в деятельности подразделений лицензионно-разрешительной работы Росгвардии и необходимость уточнения ее статуса как организующего, координирующего и контролирующего субъекта в сфере лицензионно-разрешительной работы с целью
повышения эффективности функционирования правоохранительных органов в указанной сфере.

Abstract

The concepts of licensing and permitting system and the licensing and permitting activities of the troops of the National Guard of the Russian Federation are considered. The tasks of the National Guard troops regarded to fulfilling the control and supervisory powers and providing the public
services in the field of arms trafficking, as well as private security and private detective activities, are analyzed. The features of the mechanism of law enforcement activities of the National Guard troops
in the field of licensing and permitting activities, as well as the procedure of executing the adopted decisions as one of the law enforcement stages, methods and measures of state coercion, applied
by the National Guard troops within fulfilling the licensing and permitting activities, are considered. Attention is drawn to the existing organizational problems in the activities of the licensing and permitting
divisions of the National Guard and the need to clarify its status as an organizing, coordinating and controlling subject in the field of licensing and permitting activities in order to increase the efficiency of
the law enforcement agencies’ functioning in this area.
