Аннотация

В статье рассматриваются преступления, связанные с организацией и проведением публичных мероприятий, которые коррелируют с фазой реализации протеста, образуя фактически-деятельностный этап цикла демонстративно-протестной преступности, а также преступления, связанные с укрывательством и оценочной деятельностью, которые отличают фазу завершения протеста. Обосновывается, что организационно-подготовительную фазу демонстративнопротестной преступности и ее переход в фактически-деятельностную фазу разделяют общественно опасные деяния, характеризующиеся непосредственной организацией конкретного несогласованного протестного мероприятия. Они выступают «точкой бифуркации», определяющей последующую криминальную картину протеста. Подготовив должным образом общественное мнение и
используя мобилизованные протестные ресурсы, организаторы, находясь в этой «точке», способны стимулировать граждан либо к публичному выражению своей протестной позиции, перекладывая
моральную и юридическую ответственность за возможные правонарушения во время протестной акции на самих участников мероприятия, либо к противоправной и, более того, преступной деятельности, поощряя массовые беспорядки.

Abstract

The crimes related to organizing and holding public events that correlate with the phase of protest implementation, forming the actual activity stage of the cycle of demonstrative protest crime, as well as the crimes related to concealment and evaluation activities that characterize the completion
phase of the protest, are analyzed in the article. It is substantiated that the organizational and preparatory phase of demonstrative protest crime and its transition to the actual activity phase are separated by
socially dangerous acts associated with the actual organization of a specific uncoordinated protest event. They act as a “bifurcation point” that determines the subsequent criminal nature of the protest. Having
prepared public opinion properly and using the mobilized protest resources, the organizers, being at this “point”, are able to stimulate citizens either to express their protest position publicly, shifting the moral
and legal responsibility for possible offences during the protest action to the participants of the event themselves, or to illegal and, moreover, criminal activity, encouraging mass riots.
