Abstract

Subjective and objective content of provocation of crime is revealed. The correlation of provocation of crime and incitement to commit it is analyzed. Provocation of crime is defined as inducing another person to a crime by any way aimed at the formation and implementation of concrete (specific) intent, for the purposes to bring that person to criminal liability, discredit or blackmail him(her). The examined problem is inseparable from the negative social processes taking place in the country. A comparative analysis of different points of view of domestic and foreign researchers concerning Russian criminal legislation in the context of judicial practice is conducted, including the position of the European Court of Human Rights. The special significance of the provocation of crime in crime detection activities is emphasized. Blurring the boundaries between provocation of crime and crime detection activities being actively carried out in domestic law enforcement practice due to the prevalence of procedural form over content is noted. It’s stated that the position of the European Court of Human Rights requiring the police to investigate criminal activity by “essentially passive” method seriously complicates the detection and investigation of a number of crimes, especially those related to the activities of organized groups and criminal associations (criminal organizations). Objective and subjective characteristics of crime detection actions excluding provocation of crime are stated. These are crime detection actions carried out according to the current legislation against persons who discovered the intent to commit crime. Such actions aim at preventing crimes or bringing the perpetrators to criminal liability.
