Abstract

The article is devoted to the analysis of the norm provided by part 5 of Article 34 of the criminal code of the Russian Federation, which combines qualitatively different forms of criminal activity, which are defined as complicity in the uncompleted crime and the “failed complicity” in the criminal law. The principal difference of complicity in the uncompleted crime from the failed complicity is revealed. Recommendations concerning the procedure for recording the qualification formula for complicity in the uncompleted crime (first the reference to Article 33, and then to Article 30 of the criminal code of the Russian Federation) and the failed complicity (preparing for a crime without reference to Article 33 of the criminal code of the Russian Federation) are made. Basing on the materials of judicial practice, the mistakes in the qualification of complicity in the uncompleted crime and the failed complicity are analyzed. According to the rules of the failed complicity, disputable situations are handled, in particular, when the perpetrator of the crime voluntarily does not carry out the entire volume of the criminal activity, which was originally planned jointly with other accomplices, and instead of committing the crime under specified elements agreed with the organizer, instigator or accomplice, he or she commits this crime under ordinary circumstances, as well as the situation when one of the persons participating in the crime makes the actual mistake concerning the presence of the elements of complicity.
