Abstract

The authors of the article analyze the rules providing for administrative andcriminal liability for the involvement of a minor in the process of consumption of alcohol products andproducts containing alcohol, new potentially dangerous psychoactive substances or intoxicants, tobacco,
systematic consumption (drinking) of alcohol products and products containing alcohol, intoxicants, as well as inducing juveniles to use narcotic drugs, psychotropic substances and their precursors. It is noted
that these rules do not fully correlate with each other in terms of the subject of offences (crimes), ways and methods of involving children in the process of consumption of harmful substances, as well as
determining the subject of the analyzed acts. The rules for qualifying the involvement of a minor in the consumption of new potentially dangerous psychoactive substances are proposed. The need to expand
the subject of the offence provided by Part 1 of Article 6.23 of the Code of Administrative Offences of the Russian Federation by replacing the concept of “tobacco” with the concept of “tobacco products” is
proved. In order to form a unified scientific opinion and law enforcement practice, it seems appropriate to determine an approximate list of ways of involving (inducing) a minor in the process of consumption of harmful substances in the studied rules of criminal and administrative and tort legislation.
