Abstract

The author of the article raises the topical issue of the scientific development of the concept of the ideological bases of criminal proceedings and including it in the system of the basic concepts of criminal procedure. It is stated that the concept of the ideological foundations of criminal proceedings is one of the poorly developed concepts of domestic legal theory. The arguments in favor of the theoretical development of the concept of the ideological foundations of criminal proceedings are presented in the article. The factors that prevent the emergence of such concept are analyzed, their inconsistency is shown. It is proved that modern science is characterized by predominantly intuitive approach to understanding the ideological foundations. The issues concerning the correlation between
the concepts of ideological bases and principles of criminal proceedings are touched upon. As a result of the conducted research, it is concluded that the concept of the ideological foundations of criminal proceedings can become a missing element in the system of basic concepts of criminal procedure theory and, in accordance with the principle of emergence, give new and previously unknown meanings
to the whole criminal procedure
