Abstract

The authors of the article propose to define the insanity by using the medical, psychological and legal criteria. They distinguish the temporal element as one of the elements of the legal criterion, which means the coincidence in time of the fact of committing a socially dangerous act with the pathological state of mind of the person, and thus excluding the possibility of conscious and (or) volitional behavior. The general rule for determining insanity in case the mental state of a person committing a socially dangerous act alternates towards improvement or deterioration is substantiated. According to this rule, if the person committing a socially dangerous act is in the state which excludes
conscious and volitional attitude to his (or her) behavior caused by the pathological state of mind for a longer period of time of committing this act, such person must be declared insane in relation to the
committed socially dangerous act. The peculiarities of applying this rule to continuing socially dangerous acts are considered. The definition of the concept of continuing socially dangerous acts of an insane
person is proposed. Basing on the comparison of the time limits of the psychological and medical criteria of insanity regarding a socially dangerous act, the rules of criminal law assessment of the behavior of
the person who committed this act, as well as the recommendations for improving law enforcement practice are formulated.
