Abstract

The assessment of the existing administrative legal policy of ensuring observance of the regulations on circulation of civilian weapons and ammunition is provided. The provisions of the Russian legislation on the circulation of civilian weapons and ammunition and administrative responsibility for its violation are analyzed. Certain provisions of the Federal law “On weapons”, of the Regulations on circulation of civilian and official weapons and ammunition on the territory of the Russian Federation, as well as of other legal acts, imposing the order of the licensing system functioning, are studied. The administrative practice of the law enforcement bodies in the licensing sphere is analyzed taking into account the statistical data. The problems of bringing the persons, violating the Regulations on circulation of civilian and official weapons, to responsibility are revealed. The effective Russian legislation on weapons is criticized. The judicial and administrative (non-judicial) orders of deprivation of right to keep and carry weapons (revoking the licenses and permits for keeping, keeping and carrying civilian weapons) are considered. The efficiency of the RF Administrative Code’s sanctions, applied by the courts, in forms of deprivation of right to purchase and keep or keep and carry weapons is assessed. It’s proposed to impose administrative responsibility for evasion of selling smooth-bore hunting firearms and ammunition by the persons having revoked permits for keeping them. Some proposals on improving both the legislation on the administrative responsibility for violating weapons laws and the efficiency of law enforcement bodies’ activities aimed at civilian weapons circulation control are made.
