Abstract

Agricultural products circulation and production is considered as strategic direction of the Russian economic activities. Its significance has increased manyfold after imposing sanctions, countersanctions and import substitution policy. It is stated that criminalization of agricultural products circulation hampers the implementation of the government decisions in the field of agricultural sector. The author provides statistical data and results of the public opinion pall, illustrating the large scale of agricultural products circulation criminalization level in the Russian agricultural regions (especially in the Southern Federal District). The main problems of counteraction to illegal enterprise in the field of agricultural products circulation are examined. The author proves the necessity to concentrate force on counteraction to illegal enterprise in the field of agricultural products circulation and on protecting the interests of fair farmers and entrepreneurs. Such illegal activity is considered as an independent activity performed on one’s own peril and aimed at receiving regular profit from agricultural products selling which is conducted without registration or by establishing (reorganization) legal person through man of straw or by using unlawfully obtained personal data or identity papers. It is proposed to exclude accumulation and resale of agricultural products from its turnover and to allow farmers to work directly with consumers. Purchasing agricultural products from its producers should be admitted only for the purpose of retail trade, its export, storing and (or) processing, using in industry activities.
